If you have suffered a personal injury, whether through a motor vehicle accident or through some other instrumentality, in the Province of Alberta, we can help. We work closely with a former insurance adjuster with 35 years experience to make sure that you get maximum compensation for your injuries. Please call us at 1-403-910-0401 or email us at sean@oneillaw.ca to discuss your case. The consultation is free. If we determine that we can be of assistance
to you, and you want to retain us, we will usually be prepared to
represent you on a contingency basis. This means that you will pay us a
percentage of what you recover from your injury. If you do not receive
anything, then you do not pay us anything. Our standard contingency
agreement can be reviewed here. If we agree to represent you, we will
cover the cost of obtaining reports from medical and other experts
necessary to put your case together.
You should be aware that legislation is now in force that limits the compensation you can obtain for "minor" soft tissue injuries arising from motor vehicle accidents to approximately $4,500 for pain and suffering. Minor soft tissue injuries encompass what used to be referred to colloquially as "whiplash" cases. In many instances the minor injury regulations will not apply to your case, even though at first blush they appear to. We have the expertise and experience to identify those elements in your own case which might take you outside of the restrictions imposed by the minor injury regulations. For example, are you experiencing pain in your jaw? This may mean that you have injured your temporomandibular joint (TMJ) which is not affected by the minor injury cap. If you have musculoskeletal pain this might not be covered by the cap.
The Minor Injury Regulations and the Diagnostic and Treatment Protocols contain some strict time limits that you must follow if you are not to run the risk of losing your right to make to make a claim. If you intend to make a claim for compensation, you must submit a claim to your insurer within 10 days of your accident. You have to visit a doctor, chiropractor, or physiotherapist within 90 days of your accident. Failure to do these things will likely prevent you from claiming any compensation for minor injuries. Since it is often difficult to determine the extent of your injuries just after an accident, you should do both of these things in order to preserve your rights. if you think you might have a claim you should also contact us as soon as possible after you are injured so that we can make an assessment and recommend the best strategy for dealing with the insurance company. If you have been injured, please call us.
